This application contains software from Viewdle, Inc. of Avenue of the Americas, 20th Floor, New York, New York 10020, USA (“Viewdle”). The software from Viewdle (the “Viewdle Software”) enables this application to do online identification of people appearing in video file and provides person-related information, including name, program and time information (“Viewdle Data”) from online servers (“Viewdle Servers”); it also may perform other functions. You may use Viewdle Data only by means of the intended End-User functions of this application software.
You agree that you will use Viewdle Data, the Viewdle Software, and Viewdle Servers for your own personal non-commercial use only. You agree not to assign, copy, transfer or transmit the Viewdle Software or any Viewdle Data to any third party. YOU AGREE NOT TO USE OR EXPLOIT VIEWDLE DATA, THE VIEWDLE SOFTWARE, OR VIEWDLE SERVERS, EXCEPT AS EXPRESSLY PERMITTED HEREIN.
You agree that your non-exclusive non-commercial license to use the Viewdle Data, the Viewdle Software, and Viewdle Servers will terminate if you violate these restrictions. If your license terminates, you agree to cease any and all use of the Viewdle Data, the Viewdle Software, and Viewdle Servers. Viewdle reserves all rights in Viewdle Data, the Viewdle Software, and the Viewdle Servers, including all ownership rights. Under no circumstances will Viewdle become liable for any payment to you for any information that you provide, including video identification information. You agree that Viewdle may enforce its rights under this agreement against you directly in its own name.
Viewdle uses a unique identifier linked to a valid email address provided by you to track queries for statistical purposes. The purpose of a randomly assigned numeric identifier is to allow Viewdle to count queries without knowing anything about who you are (other than the email address you provided to us). THE VIEWDLE SOFTWARE AND EACH ITEM OF VIEWDLE DATA ARE LICENSED TO YOU “AS IS.” VIEWDLE MAKES NO REPRESENTATIONS OR WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE ACCURACY OF ANY VIEWDLE DATA FROM THE VIEWDLE SERVERS. VIEWDLE RESERVES THE RIGHT TO DELETE DATA FROM THE VIEWDLE SERVERS OR TO CHANGE DATA CATEGORIES FOR ANY CAUSE THAT VIEWDLE DEEMS SUFFICIENT. NO WARRANTY IS MADE THAT THE VIEWDLE SOFTWARE OR VIEWDLE SERVERS ARE ERROR-FREE OR THAT THE FUNCTIONING OF THE VIEWDLE SOFTWARE OR VIEWDLE SERVERS WILL BE UNINTERRUPTED. VIEWDLE IS NOT OBLIGATED TO PROVIDE YOU WITH ANY ENHANCED OR ADDITIONAL DATA TYPES THAT VIEWDLE MAY CHOOSE TO PROVIDE IN THE FUTURE AND IS FREE TO DISCONTINUE ITS ONLINE SERVICES AT ANY TIME. VIEWDLE DISCLAIMS ALL WARRANTIES EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. VIEWDLE DOES NOT WARRANT THE RESULTS THAT WILL BE OBTAINED BY YOUR USE OF THE VIEWDLE SOFTWARE OR ANY VIEWDLE SERVER. IN NO CASE WILL VIEWDLE BE LIABLE FOR ANY CONSEQUENTIAL OR INCIDENTAL DAMAGES OR FOR ANY LOST PROFITS OR LOST REVENUES.
